Terms of Service

Last updated November 2, 2026

These terms are an agreement between you (the business using our service, "you") and Small Biz Automated ("we", "us"). By creating an account or paying for a plan, you agree to them.

1. The service

We provide automation for small businesses through our client portal: online booking, reminders and confirmations, review requests, rewards and deals, social posts, missed-call text-back, AI phone answering, quotes and invoices, and team tools, depending on your plan. Features may change as we improve the service.

2. Your account

3. Plans, billing and refunds

4. Texting, calls and consent

You are responsible for following the laws that apply to your messages and calls, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM and carrier rules. In particular:

5. Acceptable use

You may not use the service for anything illegal, deceptive, harassing or hateful; for spam; for content carriers do not allow (such as cannabis, firearms sales, high-risk lending or adult content); or to try to break, overload or reverse-engineer the service.

6. Your data

You own your business and customer data. You give us permission to use it only to provide the service, as described in our Privacy Policy. You can export key records from the portal, and we delete your data after you close your account as the Privacy Policy describes.

7. Connected services

The service works with other companies' products, such as Square, Twilio, Vapi, Resend, Google and Meta. Their own terms apply to your use of them, and we are not responsible for their outages, pricing or changes. If you connect your own provider accounts, you pay those providers directly.

8. AI features

AI phone answering and AI-written content can make mistakes. Review your receptionist script, prices and policies, and check important bookings. You are responsible for promises made using the information you provide.

9. Guidance is not professional advice

Checklists and guidance in the portal (for example getting your business registered, W-2 and 1099 onboarding, or tax-time downloads) are general information, not legal, tax or accounting advice. Talk to a professional for your situation.

10. No warranty

We work hard to keep the service running, but it is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not promise any specific number of bookings, reviews or sales.

11. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental or lost-profit damages, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

12. Ending service

You can stop at any time. We may suspend or close accounts that break these terms, misuse texting, or do not pay, and we will tell you why when we can.

13. Changes to these terms

We may update these terms. We will change the date above and tell you about important changes at least 14 days before they take effect. Continuing to use the service means you accept them.

14. Governing law

These terms are governed by the laws of the State of Florida. Disputes will be handled in the courts of Brevard County, Florida.
